The Government of India has again allowed surrogate mothers to carry your baby in India, subject to the following criteria.

It provides for the constitution of surrogacy boards at the national as well as state levels to ensure effective regulation.
It seeks to allow ethical altruistic surrogacy to the intending infertile Indian married couple between the age of 23-50 years for females and 26-55 years for males.
Surrogacy in India is exclusively available to Indian couples.
Indian citizens with an H-1 visa or Green Card in the USA can undergo surrogacy in India. However, it is not permissible for individuals of Indian origin who are now US citizens with a US passport. There are alternative low-cost options available for US citizens.
Your child will acquire Indian citizenship by birth through surrogacy.
The couple must obtain certificates of essentiality and eligibility before proceeding with surrogacy.
It is mandated that intending couples must not abandon the child born through surrogacy under any circumstances. The newborn child is entitled to all rights and privileges as a natural child.
The Bill also aims to regulate the operations of surrogacy clinics. All surrogacy clinics in the country must be registered by the appropriate authority to conduct surrogacy or related procedures.
It also specifies that no sex selection can be done when it comes to surrogacy.
